This document, through its content, makes available to users the Regulation on the Terms and Conditions of use of the site www.jackscustomhats.com.

The website www.jackscustomhats.com is operated by Varzopov Mădălin PFA, based in Bucharest, 032327, No. 30A, 32-34 Ninsorii Alley, Corp C1, S.T. 4, Room 2, sector 3, Romania, registered in the Trade Register – Unique Registration Code 43210286, hereinafter referred to as “the Company”. The natural or legal person who orders and purchases products through the site www.jackscustomhats.com is hereinafter referred to as the Customer.

The company reserves the right to change the content and/or structure of the website at any time and without any prior notice. The use of this site implies acceptance of these terms and conditions. In order to use the site in good conditions, it is recommended to read the Terms and Conditions carefully.

The entire content of the site www.jackscustomhats.com is the property of the Company and is protected by copyright law (Law No. 8/1996). The use without the written consent of the Company, of any information, data or photographs, drawings, logos, video or audio materials, is punishable in accordance with the legislation in force (administrative, civil or criminal).

Downloading or copying materials from this site is permitted for personal, non-commercial use only. Reproduction (except for personal, non-commercial use), publication, transmission, distribution, display, deletion, addition, modification, creation of derivative works, sale or participation in the sale of any material in the content of this site, any related software is not permitted. Any other use of the materials on this website, including reproduction for purposes other than personal, non-commercial, modification, distribution or republishing, without the prior written consent of the Company, is strictly prohibited.

Security of personal data and information

The personal data entered by the Customer will be used by the Company only for the stated purpose of this site: invoicing, delivery of ordered products, order confirmation, possible promotions, facilitating communication with its customers, informing them about the operation of the site, etc.

The information in the order form will not be provided to a third party unless following an explicit request from the Customer.

At www.jackscustomhats.com, the user is responsible for all activities that occur by accessing it. The company cannot be held responsible for errors caused by the user’s negligence regarding the security and confidentiality of personal data.

However, personal data may be transmitted to the authorities entitled to verify commercial transactions or to other authorities entitled to carry out any justified checks under the law, if so requested in accordance with applicable law.

The company guarantees the security and confidentiality of the data hosted and transmitted through its informatic system but does not assume responsibility for loss of information caused by any defects or errors in the software with which the site is designed and hosted and does not guarantee that the site, server/servers or emails sent by contact@jackscustomhats.com do not contain viruses or other harmful components. The Company is also not responsible for failures that jeopardize the security of the server on which the site is hosted.

Site content and disclaimer

The Company does not assume any responsibility and cannot be held liable for any damage resulting from accessing the information presented on the site or from the inability to use the information.

By launching an order and purchasing a product/products, the customer accepts without objection the conditions and terms of use, which have the value of a valid contract.

In the event that the price of the product or some of its features have been entered incorrectly in our databases or displayed incorrectly and the delivery has not yet taken place, the Company reserves the right to cancel the delivery of that product and notify the customer as soon as possible about the error. The maximum value of the Company’s obligations towards any customer, in case of non-delivery or improper delivery, is the value of the amounts collected by the Company from that customer.

Our store assumes no responsibility for any damage that visitors may have due to the temporary malfunction of this site.

The Company is not responsible for the content and quality of the sites reached through links on the site www.jackscustomhats.com, regardless of the nature of these links. For those sites, the responsibility lies entirely with the owners of the sites in question.

The Company does not guarantee that the description of the products or any other content of the site is free of errors or that it is complete. It also does not assume responsibility and cannot be held liable for any damage caused by using in any way the products purchased through this site.

The product descriptions on this site are informative and are subject to change without notice. Prices can be updated without prior notice. That is why it is recommended to review the prices when you place an order.

If payment is made in advance, the customer will be entitled to a refund of the money paid for the product. In all cases where the products cannot be delivered, the customer will be able to request only the immediate return of the amounts already collected by the Company, but not other compensations.

Also, the Company is not responsible and will not be held responsible for the malfunction of the site, information, content, materials or products on the site.

Any complaint will be notified to the Company within 24 hours of receipt of the products.

Promotions and contests

The company establishes its own regulations for the promotions and contests it organizes. These regulations are made known to potential participants only through its own website. Promotions apply only to those orders that follow exactly the rules displayed on the site. Also, promotions apply only to orders that are registered during the time the promotion is valid and only within the available stock. The Company does not guarantee the stock availability for the products of the promotion and may interrupt or cancel any promotion at any time without prior notice.

Online shopping

Orders can be placed on the website by people who have reached the age of 18 until the day the order is placed and who have accepted the terms and conditions imposed.

All information on our website is for informational purposes, it is not the subject of a Commercial Contract, until the moment of placing and confirming an order.

After placing an order in our store, we will send you a notification email regarding the receipt of your order.

The acceptance of the order will be notified to you by email in the form of Order Confirmation. The contract between our company and the buyer becomes valid at the time of sending the Order Confirmation and refers strictly to the confirmed Products. An unconfirmed order has no contract value.

We reserve the right, at any time and at our discretion, to refuse acceptance of an order, for any reason and without being liable to the Customer. Orders may only be placed by individual customers and corporations purchasing goods other than for resale.

The customer can use the website and place an order without the obligation to create an account or register.

The contract is considered valid at the time when the email containing the Order Confirmation is sent to the buyer. Please check the content of the order confirmation and notify any errors found at our email address contact@jackscustomhats.com.

If errors occur and some products are posted with the wrong price, you will be contacted and will have the option to confirm the order at the correct price or cancel it. If you cannot be contacted, the order will be considered canceled and the refund procedure will be used.

We do not undertake to honor orders that have as object products whose price is wrong, and the mistake is noticeable, the price displayed not falling within our usual price scale. We reserve the right to change the price of the products posted on the site at any time, except for products that are the subject of a confirmed order.

Regarding discount vouchers, these discounts do not combine with other promotions and do not apply to products already on sale.

Product information

We have made efforts to present the colors of the products as accurately as possible. However, some colors may differ in shade/tint between the actual product and its image on the site. These differences may occur as a result of image processing or differences between monitors.

The sizes of each hat are displayed in centimeters as well as inches and US standards. Please note that, being handmade, some sizes may vary slightly.

Guarantee

The Company guarantees that, at the time of delivery, the purchased goods have the characteristics and correspond to the description in the order placed and approved by the buyer.

The warranty period for the products is 1 (one) year. During this period, the buyer benefits free of charge from repairing or replacing the products that have manufacturing defects.

In order to benefit from the product warranty, the buyer undertakes to comply with all instructions for use and maintenance provided by the manufacturer.

The warranty covers:

– manufacturing defects;

– loose seams

– damaged/detached accessories

– detached lining

The warranty does NOT cover:

– normal signs of behavior;

– spots;

– loss of the brim/crown shape (it is natural for a hat to lose its structure over time)

– loss or theft

– intentional or accidental damage

For repair requests, please email us at contact@jackscustomhats.com with the following information:

– name and surname

– description and photos of the defects for which repair is requested

To send the hat for repair, it must be sent in a package similar to the one in which it was received. Improper packaging can cause additional defects in the hat that are not covered by the warranty or cannot be remedied.

If the defects cannot be remedied, the hat will be replaced with a new one. If, for objective reasons, the hat can no longer be manufactured, it will be replaced with another, at the customer’s choice.

International shipments must also cover the cost of returning the package.

Payment

The prices displayed in our store are expressed in LEI (for Romania) and EURO (for the rest of the world) and do NOT bear VAT.

For the products delivered on the Romanian territory, the transport is FREE.

Also, for orders outside Romania, the customer is responsible for the payment of any customs duties applicable in the destination country.

Delivery

The estimated delivery time of the products purchased from our store is 8-10 weeks from the time of payment. However, given the current context (COVID-19), this deadline may be extended, regardless of our will.

In all cases where the products cannot be delivered, the customer will be able to request only the immediate return of the amounts already collected by the Company, but not other compensations.

Orders will be shipped to the address indicated in the order form. The Company is not responsible if the data provided is incorrect. Also, no deliveries are made to mailboxes or restricted areas.

Once the product has come into buyer’s possession, all the risks regarding damage or loss of the product pass to the customer.

Product return

Returnable products

Returnable products are those that do not have customized elements.

If there is dissatisfaction with the purchased products, the Customer has the right to unilaterally cancel the order, notifying in writing that he renounces the purchase, without penalties and without invoking a reason, within 14 calendar days of receiving the product. Disclaimer is applicable only to individual customers.

The customer may request a different size or color of the same product or may request a full refund of the price paid.

The returned product must be in the same condition in which it was delivered, in the original packaging or equivalent, without signs of wear, both for the product and the accessories/consumables accompanying it, with intact labels and original documents accompanying it (invoice, instructions, etc.).

Products that have been damaged during transport to us are not accepted for compensation.

The return of the products will be made at the customer’s expense. Upon receipt, the package will be checked to see if it meets the above conditions; otherwise it will be refused. Thus, packages containing products in a condition other than the one in which they were delivered, those whose return has not been notified in advance, as well as those containing products damaged during transport due to improper packaging by the Customer will be rejected.

According to the law, the Company will return the value of the order within 14 calendar days from the return date, by bank transfer to the account specified by the customer.

Return of the products is subject to this law only for products that are delivered to customers through the courier service. Orders that have been picked up from the Company’s headquarters or transported directly to customers through their own staff or intermediaries are not considered distance trading, as they can be viewed, verified and accepted in person, appropriate to the customer’s purpose and needs.

Non-returnable products

The products that are personalized are NOT returnable; however, if the hat is not a “perfect match”, we can work together to remedy this.

Disputes and conflicts

Any attempt to gain unauthorized access to the site www.jackscustomhats.com or attempted fraud will be reported to the competent authorities. Any conflict between the Company and the Customers will be solved amicably by agreement between the two parties. If this is not possible, the Romanian legal provisions in this field will be applied, and the settlement of disputes is within the competence of the courts. By agreeing to these Terms and Conditions, the customer fully assumes these risks.
